NSSMC introduces changes to the terms of submission of reports and information by professional participants due to the adoption of new legislation

The NSSMC (National Securities and the Stock Market Commission) has made amendments to the Resolution on the submission by professional participants of the capital markets and organized commodity markets of reporting data and information to the NSSMC during martial law.

The establishment of new requirements is connected with the entry into force of the Law of Ukraine On Amendments to Certain Legislative Acts of Ukraine on Regarding the Peculiarities of the Activities of the Financial Sector in Connection with the Introduction of Martial Law in Ukraine dated July 27 №2463-IX (hereinafter – the Law).

Professional participants of the capital markets and their associations must submit reporting data and other information, information and documents that were not submitted to the NSSMC within 60 calendar days from the date of entry into force of the Law for the entire period of non-submission.

Professional participants of organized commodity markets must provide data, information and documents (except reporting data) that had not been submitted to the NSSMC on the date of entry into force of the Law, within 60 calendar days from the date of entry into force of the Law.

Professional participants of organized commodity markets must submit reporting data that had not been submitted to the NSSMC by the date of entry into force of the Law in the following terms:

⁃ monthly reporting data for July – December 2021, January – August 2022, – within 90 calendar days from the date of entry into force of the Law;

⁃ annual reporting data for 2021 – within 90 calendar days from the date of entry into force of the Law.

The first reporting period for the submission of reporting data to the NSSMC is:

⁃ for daily reporting data – the sixty-first calendar day following the date of entry into force of the Law;

⁃ for irregular reporting data – the sixty-first calendar day following the date of entry into force of the Law.

An exception is financial statements and references to information about the auditor’s report, which are part of the reporting data. They can be submitted within three months after the end of martial law for the entire period of their non-submission.
